The company Premium Barefoot, s.r.o., ID No.: 21076430, with its registered office in Prague 1, Palackého 9/718, Postcode: 110 00 (hereinafter referred to as "we" or "us"), protects all personal data provided to us during registration, ordering, and/or purchasing (first name, last name, address, telephone number, email address) against misuse and processes it in accordance with current legislation. We would like to take this opportunity to familiarize you with some new rules and information in connection with the new European personal data protection legislation (the GDPR regulation, which became effective in the European Union, and therefore also in the Czech Republic, on May 25, 2018), as the security of your personal data is our priority, and at the same time, we want you to be able to continue using all our services without any restrictions.

In this document, you will find basic and clear information about what personal data we process about our customers for the purposes of processing orders and registration in our online store, the legal ground on which we process the data, the specific purposes for which we use it, to whom we may transfer it, and what rights you have in connection with the processing of your personal data. All details, in particular regarding further purposes and methods of processing, processing periods, as well as your rights in connection with the processing of your personal data, can also be found at www.naboso.cz in the "Privacy Policy" section.

What personal data do we process?

We process the following personal data:

a)

identification data, which means in particular first name and last name, username, and password;

b)

contact data, which means personal data that allows us to contact you, in particular email address, phone number, postal address, and your social media profile;

c)

your settings, which means the data in your account, in particular saved addresses and profiles, and your ratings of products and services;

d)

data about your orders, which means in particular data about the goods and services you ordered, the method of delivery and payment, including the payment account number, and data about complaints;

e)

data about your behavior on the website, in particular the goods and services you view, the links you click on, the way you move around our website and scroll the screen, as well as data about the device from which you view our website, such as the IP address and location derived from it, device identification, its technical parameters such as the operating system, its version, screen resolution, the browser used and its version, as well as data obtained from cookies and similar technologies for device identification;

f)

derived data, which means personal data derived from your settings, data about the goods and services for which you place an order with us, and data about your behavior on the website; in particular, this includes data about your shopping behavior and relationship to various goods and services.

If you visit our website

If you visit our website, we store and subsequently read small files such as cookies on your device. A cookie is a small file of letters and numbers that we store in your internet browser or on your computer's hard drive. Some cookies allow us to link your activities while browsing our site from the moment you open the web browser window to the moment you close it. The moment you close the internet browser window, these cookies are deleted. Others remain on the device for a set period of time and are activated every time you visit the website that created that specific cookie. Furthermore, we use pixel tags (also known as web beacons), which are small images that have a similar function to cookies. Unlike cookies, which are stored on your computer's hard drive, pixel tags are an integral part of web pages. For simplicity, we will refer to all these technologies as cookies throughout this document. We not only store cookies on your device, but we also read cookies that our website has stored on your device. For simplicity, we will only talk about storing further in this document.

  • ensure security, for example, to investigate whether someone has misused your connection to our website and is acting on your behalf;

We do not obtain data about your behavior on the website solely from cookies. We also supplement it with data such as:

  • the IP address of your device (the address of your device through which you communicate with other devices on the internet),
  • the MAC address (the hardware address of the device through which you communicate with other devices in the local network),
  • the operating system of your device, its version, and language settings;
  • the browser you use on your device, its version, and language settings;
  • the address of the web page (URL address) from which you come to our website.

We process this data about your behavior on the website on the basis of our legitimate interest (i.e., without your consent) for the purpose of:

  • obtaining information based on which we will be able to improve the website for you in the future; our legitimate interest here is the improvement of our services for you;
  • creating statistics and overviews, in particular monitoring traffic to our website and its individual pages, and measuring advertising effectiveness; our legitimate interest here is measuring the effectiveness of our website and advertising expenditures; for this purpose, we may obtain further derived data from your behavior on the website and use it for this purpose;
  • testing new features and applications before deployment, in particular to avoid functionality problems with these new features in live operation, which could worsen your experience of using our services; our legitimate interest here is the trouble-free functionality of our services for you;
  • preventing attacks on our website and threats to its functionality and the security of your data; our legitimate interest here is the trouble-free functionality of our services for you and the security of your data.

For these purposes, we use personal data for the period strictly necessary. You have the right to object to this processing.

If you grant us your consent when visiting the website, we may also use the data about your behavior on the website to customize our web pages and display targeted advertising, as described in the section Sending Tailored Offers and Targeted Advertising, and transfer it for the purpose of displaying targeted advertising also to operators of social and advertising networks, as described in the section Transfer of Data and Display of Personalized Advertising on Social and Advertising Networks.

  1. Why do we process personal data and what entities us to do so?

If you register on our online store at www.naboso.cz, create an order with us, or purchase from us, we process your identification and contact data, data about your orders, and your settings (if you have an account with us) primarily for the purpose of fulfilling our contractual obligations (delivery of ordered products), i.e., without your consent.

In the case of registration, ordering, or purchasing, we also process your identification and contact data, as well as data about your orders, your settings (if you have an account with us), and data about your behavior on the website based on our legitimate interest (i.e., without your consent), for the purpose of creating customized offers and targeted advertisements that we display to you on the website. Our legitimate interest here is a maximally personalized and effective offer for you. For the purpose of creating customized offers and targeted advertisements, we also enrich the named data through analysis and obtain derived data from your settings, data about the goods and services for which you create an order with us, and data about your behavior on the website. For this, we may also use data about your behavior on the website that we legitimately obtained before you created an order or registered, and we can collect data about your behavior on the website for it even if you do not log in (e.g., when we identify you using a cookie or similar technology). According to this data, we also segment our users into different groups.

For a better understanding, here is an example: If you have viewed children's summer shoes on our website, we may display this type of footwear on the first page of our website during your next visit. Based on the type of assortment you have viewed, we can also deduce which customer group you belong to, and accordingly offer you other products on the website that might interest you according to our assessment.

You have the right to object to this processing.

Sending Offers

If you do not refuse the sending of offers when providing contact details or at any time later, we may use your contact details for sending offers via email, text message, social networks, communicating them over the phone, or by other electronic means, or we may send them to you by mail. These offers will concern our products and services.

Your personal data that you provide to us as part of ordering goods or services, creating and using an account, or when communicating with us, for example at the call center, as well as data about your orders, your web profile, movement on the website, or reading newsletters, are processed based on our legitimate interest (i.e., without your consent) for the purpose of creating the most suitable messages about discount campaigns or other offers, news, and advertisements displayed to you on www.naboso.cz.

For this purpose, we further supplement contact data with data about goods and services for which you place an order with us. We can also use data about your movement on the website received from you before you created an order or registered, and we can also collect data about your movement on the website even if you do not log in via your club profile (e.g., when we identify you using a cookie or similar technology). This data also allows us to place you in the correct profile group when sending our special promotional offers. If, for example, you view our detective stories offer on our website or via a newsletter, we will display the latest titles from that genre to you during your next visit to our website.

You naturally have the right to refuse the use of this personalized service.

Who processes your personal data and to whom do we transfer it?

We process all the mentioned personal data as the controller. This means that we determine the purposes defined above for which we collect your personal data, determine the means of processing, and are responsible for its proper execution. For the processing of personal data, we also use the services of other processors who process personal data only according to our instructions and for the purposes described in section B. 'Why do we process personal data and what entitles us to do so?' Such processors are:

a)

cloud service providers and other technology and support suppliers;

b)

operators of marketing tools who help us with website optimization and content personalization;

b)

operators of marketing tools who help us with website optimization and personalization of content and offers for you;

c)

providers of SMS communication and chat tools, in cases where they process personal data to intermediate our communication with you;

d)

service providers in connection with the processing of shipments (catalogs and other communications), including in particular their delivery agents.

From what sources do we obtain personal data?

In most cases, we process personal data that you provide directly to us as part of ordering goods or services, creating and using an account, or when communicating with us, for example at the call center. We also obtain personal data directly from you by monitoring your behavior on our website and when reading messages.

Transfer of data outside the EU

As part of transferring data to the recipients listed in Section C. 'Who processes your personal data and to whom do we transfer it?', we may also transfer your data to third countries outside the European Economic Area, including countries that do not ensure an adequate level of personal data protection. We will carry out any such transfer only if the relevant recipient undertakes to comply with the standard contractual clauses issued by the European Commission, available at http://eur-lex.europa.eu/legal-content/en/TXT/?uri=CELEX%3A32010D0087.

What are your rights when processing personal data?

Right of access: You have the right to know what data we process about you, for what purpose, for how long, where we obtain your personal data, to whom we transfer it, who processes it besides us, and what other rights you have related to the processing of your personal data. You can learn all this in this document and on the website www.naboso.cz in the "Privacy Policy" section. However, if you are not sure which personal data we process about you, you can ask us for confirmation as to whether or not personal data concerning you is processed by us, and if so, you have the right to access this personal data. As part of the right of access, you can ask us for a copy of the processed personal data, whereby we will provide the first copy free of charge and further copies with a fee.

Right to rectification: To err is human. If you find that the personal data we process about you is inaccurate or incomplete, you have the right to have us correct or supplement it without undue delay. Right to erasure: In some cases, you have the right to have us erase your personal data. We will erase your personal data without undue delay if one of the following reasons is met: we no longer need your personal data for the purposes for which we processed it; you withdraw your consent to the processing of personal data, where the data is data for whose processing your consent is necessary and at the same time we have no other reason why we need to continue processing the data; you exercise your right to object to processing for personal data that we process based on our legitimate interests and we find that we no longer have any such legitimate interests that would justify this processing, or you believe that the processing of personal data carried out by us has ceased to comply with generally binding legal regulations. This right does not apply if the processing of your personal data remains necessary for the fulfillment of our legal obligation or the establishment, exercise, or defense of our legal claims.

Right to restriction of processing: In some cases, in addition to the right to erasure, you can use the right to restriction of processing of personal data. This right allows you in certain cases to request that your personal data be marked and that these data not be the subject of any further processing operations – in this case, however, not forever (as in the case of the right to erasure), but for a limited time. We must restrict the processing of personal data when: you contest the accuracy of the personal data, before we agree on what data is correct; we process your personal data without a sufficient legal basis (e.g., beyond what we must process), but you prefer only its restriction before the erasure of such data (e.g., if you expect that you would provide such data to us in the future anyway); we no longer need your personal data for the aforementioned processing purposes, but you require it for the establishment, exercise, or defense of your legal claims, or you object to processing. For the period during which we investigate whether your objection is justified, we are obliged to restrict the processing of your personal data.

Right to object to processing: You have the right to object to the processing of personal data that occurs based on our legitimate interest. If it concerns marketing activities, we will stop processing your personal data without further delay; in other cases, we will do so unless we have compelling legitimate grounds to continue such processing.

Right to lodge a complaint: Exercising your rights in the manner stated above does not affect your right to lodge a complaint with the relevant supervisory authority. You can exercise this right in particular if you believe that we are processing your personal data unlawfully or in violation of generally binding legal regulations. You can lodge a complaint against the processing of personal data carried out by us with the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), located at Pplk. Sochora 27, 170 00 Prague 7.

In all matters related to the processing of your personal data, whether it is an inquiry, exercising a right, lodging a complaint, or anything else, you can turn to us:

a) via email at the following address info@groundies.cz, if you have communicated with us electronically.

We will handle your request without undue delay, but at most within one month. In exceptional cases, in particular due to the complexity of your request, we are entitled to extend this period by another two months. We will, of course, inform you of any such extension and its justification.

These conditions enter into effect on January 3, 2024.
